Terms of service
Effective Date: 16 September 2026
These Terms of Trade ("Terms") apply to all goods supplied by Sydney Taps ("Sydney Taps", "we", "us" or "our").
By placing an order with Sydney Taps, you ("the customer", "you" or "your") acknowledge that you have read and agree to these Terms.
These Terms should be read together with any quotation, invoice, order confirmation and applicable product or manufacturer information.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (ACL) or other applicable legislation.
1. Orders
All orders are subject to acceptance by Sydney Taps and product availability.
Before placing an order, customers are responsible for confirming:
- Product selection
- Product dimensions
- Quantity
- Colour and finish
- Compatibility with other products
- Intended application
- Installation requirements
- Delivery requirements
Once an order has been accepted, changes or cancellations may not be possible, particularly for special-order, custom-made or non-stock products.
2. Quotations and Pricing
Unless otherwise stated, quotations are valid for the period specified on the quotation.
Prices may change where:
- Supplier pricing changes
- Freight costs change
- Currency fluctuations occur
- Products are discontinued
- Manufacturer or supplier surcharges apply
- The quotation period has expired
A quotation does not constitute confirmation that stock is available unless expressly stated.
3. Product Availability
Product availability and estimated delivery dates are provided as a guide only.
Sydney Taps will endeavour to provide accurate information regarding availability and estimated delivery timeframes. However, delays may occur due to manufacturers, suppliers, freight providers, customs, port delays or circumstances outside our reasonable control.
Customers should allow sufficient time between delivery and installation to inspect goods and resolve any issues before installation commences.
Sydney Taps is not responsible for project delays arising from product availability or freight delays beyond our reasonable control.
4. Product Variations
Variations may occur between products, samples, displays and production batches.
These may include variations in:
- Colour
- Shade
- Tone
- Pattern
- Texture
- Veining
- Finish
- Calibre
- Nominal dimensions
Natural stone, marble, ceramic, porcelain, fireclay and other natural or manufactured materials may contain characteristics inherent to the product.
These characteristics are not necessarily defects.
Customers should consider these characteristics when selecting products and should inspect samples and products before installation where appropriate.
5. Product Selection, Quantities & Batch Consistency
Customers are responsible for ensuring that the products selected are suitable for their intended application and that sufficient quantities are ordered to complete the project.
5.1 Product Quantities
Customers should allow for sufficient additional product to accommodate:
- Cuts and wastage
- Breakages during installation
- Future repairs or replacements
- Variations in installation requirements
We strongly recommend retaining spare tiles after installation, as matching products may not be available in the future.
5.2 Tile Shade, Tone and Batch Variation
Tiles are manufactured in batches and variations may occur between batches. These variations may include colour, shade, tone, texture, pattern and finish.
Where colour or shade consistency is important, customers should ensure sufficient quantities are ordered at the commencement of the project.
Customers should check batch, shade and calibre markings on tile cartons and, where appropriate, inspect tiles from multiple cartons before installation.
Sydney Taps cannot guarantee that tiles ordered at a later date will match tiles supplied from an earlier batch.
5.3 Samples and Displays
Samples and showroom displays are intended to provide an indication of the product only.
Due to manufacturing processes and the characteristics of natural and manufactured materials, the final product may vary from samples or display pieces.
Customers should satisfy themselves that the product is suitable for their project before installation.
6. Product Suitability
Customers are responsible for ensuring that products selected are suitable for their intended application.
This includes consideration of:
- Wet and dry areas
- Slip resistance
- Internal and external applications
- Structural requirements
- Waterproofing
- Drainage
- Substrate suitability
- Installation systems
- Environmental conditions
Where necessary, customers should obtain advice from a suitably qualified professional before purchasing or installing products.
Sydney Taps may provide product information and recommendations based on information available to us; however, final responsibility for confirming suitability for a particular project rests with the customer and their relevant designer, builder, architect or installer.
7. Inspection Upon Delivery
All goods should be inspected as soon as reasonably practicable following delivery.
Customers should check that:
- The correct products have been supplied
- The quantity is correct
- Goods are free from visible damage
- Products correspond with the order
Any visible damage, shortage or incorrect goods should be reported to Sydney Taps promptly, together with clear photographs.
Where delivery documentation is provided, customers should record any visible damage or shortage on the delivery documentation before signing.
Nothing in this clause limits any rights available under the Australian Consumer Law.
8. Pre-Installation Inspection
All products must be thoroughly inspected before installation.
Customers and installers should check:
- Product type
- Dimensions
- Colour
- Finish
- Quantity
- Batch or shade
- Visible condition
- Suitability for the intended application
DO NOT INSTALL a product if you believe it is damaged, defective, incorrect or unsuitable. Contact Sydney Taps before installation.
Customers should ensure that all concerns are raised before installation commences.
9. Installation
Products must be installed in accordance with:
- Manufacturer's installation instructions
- Applicable Australian Standards
- The National Construction Code, where applicable
- Relevant industry requirements
Sydney Taps strongly recommends that products are installed by suitably qualified and licensed tradespeople where required.
Customers are responsible for ensuring that their installer understands the requirements of the product and intended application.
10. Returns and Change of Mind
All returns must be authorised by Sydney Taps before goods are returned.
Where Sydney Taps agrees to accept a change-of-mind return, goods must:
- Be unused
- Be uninstalled
- Be in original condition
- Be free from damage or signs of wear
- Have original packaging intact
- Be suitable for resale
Approved change-of-mind returns may be subject to a 25% restocking fee.
Original delivery charges are non-refundable and return freight is the responsibility of the customer unless otherwise agreed.
Special-order, custom-made and made-to-order products may not be eligible for change-of-mind returns.
This section does not apply to goods that are faulty, defective, damaged or incorrectly supplied, or where a remedy is otherwise available under the Australian Consumer Law.
11. Cancellations
Cancellation requests must be made in writing.
Cancellation of an order is subject to the status of the order and whether goods have already been ordered, manufactured, dispatched or specially sourced.
Special-order, custom-made and non-stock products may not be cancellable once an order has been placed with the supplier.
Where cancellation is permitted, reasonable costs already incurred by Sydney Taps may apply.
12. Delivery
Delivery timeframes are estimates only.
Unless otherwise agreed, deliveries are generally made to the ground floor and goods will not be carried inside the property.
Customers are responsible for ensuring:
- Safe access
- Suitable delivery conditions
- Adequate access for the delivery vehicle
- Someone is available to receive the goods where required
- Appropriate space is available for unloading
Additional delivery or redelivery charges may apply where delivery cannot be completed due to circumstances within the customer's control.
13. Collections
Collections must be arranged in advance.
Collection Hours: Monday to Friday, 10:00 am – 4:00 pm
Customers collecting goods are responsible for providing a suitable vehicle capable of safely transporting the goods.
Sydney Taps may refuse to load goods where a vehicle is considered unsuitable or unsafe.
Customers are responsible for ensuring goods are properly positioned, restrained and secured before leaving our premises.
14. Storage
Goods should be collected or delivered within the agreed timeframe.
Unless otherwise agreed, Sydney Taps will store goods for up to 14 days from notification that the order is ready for collection or delivery.
After this period, a storage fee of $100 per week will apply.
Storage fees will continue to accrue until the goods are collected or delivered.
Sydney Taps may require outstanding storage fees to be paid before goods are released.
Additional handling, freight or redelivery costs arising because goods remain uncollected or delivery cannot be completed due to circumstances within the customer's control may also be charged.
15. Freight and Handling
Freight charges are calculated based on the information available at the time of quotation.
Additional charges may apply where:
- Delivery conditions differ from those originally advised
- Special equipment is required
- Redelivery is required
- Goods require additional handling
- Access is restricted
- The delivery location changes
Customers are responsible for providing accurate delivery information.
16. Payment
Payment terms are as stated on the relevant quotation, invoice or order confirmation.
Sydney Taps reserves the right to withhold delivery or collection of goods where payment is outstanding.
17. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify those rights.
Where goods fail to meet a consumer guarantee, customers may be entitled to a remedy depending on the circumstances, including repair, replacement, refund or reimbursement of reasonably foreseeable loss or damage.
